Chairman Shaw announced that Patty Warren would be presenting item 8D - Governmental Affairs Report, in place of Sandy Shaughnessy, and asked that the agenda be approved with this change. Jim Shaw reported that Tax Watch had identified over $80 million in cultural appropriations in the 08-09 budget that bypassed the grant funding process embedded in other state agency budgets. Katharine Dickenson asked that the staff obtain a list of these projects and email the list to the members so that they could write letters to their legislators. He reiterated the need for a dedicated funding source and urged the Dedicated Funding Task Force to make this a priority. A short discussion ensued about the reminding the legislature of the importance of the arts with the Chairman repeating the grass roots approach as the best advocacy tool.
Sandy Shaughnessy again thanked the members for their advocacy efforts during the 08-09 Legislative Session. The Division’s 08-09 grants budget may see a four percent reduction as it did last year in the 07-08 budget if state tax revenues continue to decline. Ms. Shaughnessy also announced that the Division lost one FTE position with 2008-09 budget reductions, providing for only 18 FTE positions.
Division staff has been exceedingly busy with panel meetings held in April and May, working with the Auditor General’s onsite audit of the Division and Department, and preparing the Sunset Review Report to the Legislature due in July.
Janeen Mason attended one of the Division’s Individual Artist workshops facilitated by Creative Capital in May.
The Poetry Out Loud state contest winner, Monique Henry from Douglas Anderson School of Arts in Jacksonville, competed in the national contest held in Washington April 28-29.
Ms. Shaughnessy is scheduled to attend the Executive Directors’ Conference in Denver hosted by the National Assembly of State Arts Agencies (NASAA). She will be networking with other Executive Directors regarding budget strategies, funding sources and the challenges facing the arts.
The Division will be celebrating its 40th anniversary in 2009, along with the 30th anniversary of the State Touring Program. This will present a marketing and branding opportunity for the Division.
Ms. Shaughnessy announced that the Museum of Florida History and Historical Museum Grants Program will officially come under the management of the Division of Cultural Affairs on July 1, 2008, upon the Governor’s signature approval of HB 987.
Other important conferences coming upPresenters - Gaylen Phillips reported that the State Touring Program companies and individuals are given specific booking allocations and are instructed to work with underpopulated counties first. These bookings are reflected in the applications submitted by the presenters.
The deadline for 2008-2009 State Touring Presenter applications was May 1, 2008 for projects that take place from July 1, 2008 to June 30, 2009. Applications were then processed by staff and a listing of recommended awards was distributed to the Council.
The 08-09 legislative appropriation for this program is $237,781. Due to budget challenges, some applications may be “wait-listed.” Should funding become available through the decline of any current State Touring Program grants, wait-listed applications will become active as funds allow.

Jim Shaw, Panel Chair, reviewed the report as follows:
The Quarterly Grant Review Panel was held via teleconference on May 21, 2008 to recommend grant awards to organizations and individual artists.
Quarterly Assistance: One eligible Mini-grant, two Consultant, and five Special Project applications, requesting a total of $28,500, were reviewed. One Mini-grant, one Consultant, and four Special Project applications were recommended for funding. The panel chose to fully fund the Mini-grant, Consultant, and the top scoring Special Project, and the remaining Special Project applications were recommended for funding for $3,000 each for a total of $16,500.
Underserved Arts Communities Assistance: Two eligible Basic Salary Assistance Year 1, four eligible Basic Salary Assistance Year 2, and two eligible Basic Salary Assistance Year 3 applications were reviewed by the panel with requests totaling $60,000. One Basic Salary Assistance Year 1 and all of the Basic Salary Assistance Year 2 and 3 applications were recommended for funding based on 07-08 budget figures. Additional funding from the NEA is now available to fund the one remaining Basic Salary Assistance Year 1 application in the amount of $10,000.
Artist Enhancement: A total of 101 eligible grant applications were reviewed by the panel. Forty-nine applications were recommended for funding. The panel chose to fully fund all applications that achieved a minimum score of eight points.

Public comment was as follows:
Two applicants thanked Sarah Stage for her assistance helping them through
the grant process. Someone from an arts commission in Florida commented
that the panel did an excellent job and they were impressed with our
grant review process! An artist enhancement applicant said that he liked
the cost effectiveness of the teleconference and also thought the meeting
went very well. Thanked the chair.
At the conclusion of his report, Mr. Shaw moved approval of the Quarterly Assistance Program funding recommendations. Jacqueline Bradley seconded the motion, which carried. The list of funding recommendations is listed below.

Panel comment was as follows:
Natalie Ellis commented on the funding amount as being a shame and that
the staff did an excellent job and that OASIS was difficult to get used
to. Alexa Favata echoed Natalie on the difficulty of OASIS and thanked
the chair and her co-panelists. Steven Klindt commented that OASIS was
easier to use and that the teleconference format was difficult. Kristen
Miller-Zohn thought that having a teleconference was easier.

The Dance Grant Review Panel was held via teleconference on May 15, 2008 to recommend grant awards to organizations.
Six eligible Specific Project and ten General Program Support applications, requesting a total of $661,154, were reviewed by the panel. All applications were recommended by the panel for funding.
Specific Project Funding Method: The panel chose to fund applications using the Score-based Pro-Rata Formula, with one exception to the formula. If an award amount drops below the minimum amount of $2,500 then that application will not be funded and those funds will be distributed among the remaining organizations.

The panel is very happy with the online application system. Jill Sonke
would like applicants to submit survey results and an example of a survey
instrument with their support materials. She also suggested that the
operating budget form be more detailed.

April 23 Panel
The panel reviewed 66 applications (Arts Education Partnership Level
II), and recommended funding for 57 applications. A motion was passed
unanimously by the panel.

grant category, 22 applications in the Artist Residency, and five applications

The Local Arts Agency Grant Review Panel convened via teleconference on May 19, 2008 to recommend funding for the next three-year grant cycle - 08/09, 09/10, 10/11. A complete list of all applications reviewed by the panel, including panel scores, is provided on the following pages.
The panel reviewed and scored 22 applications. All of the applications received a score of 75 or above. A motion to accept the scores was passed unanimously by the panel; therefore, all of the applications were recommended for funding.

May 22, 2008
The Culture Builds Florida Expansion Funding Panel Meeting was held
via teleconference on May 22, 2008 to recommend grant awards to organizations
for projects in the Culture Builds Florida Grant Program.
The panel reviewed forty-four eligible applications and recommended the four highest scoring applications for full funding. Applications were accepted for projects that explored the connections between arts and cultural programming and the four key areas of the Division’s strategic plan.
Project applications were accepted for a variety of activities including a cultural tourism web site, an artist residency project, an exhibition accessibility expansion, and a library dance program. The four organizations recommended for funding for this first cycle are:

Panel comment was as follows:
Panelists mentioned that they were impressed with the overall quality
of the applications. One out of state panelist mentioned that she would
highly recommend some of the projects reviewed to other private funding
sources. Panelists mentioned that with the high quality of projects
submitted, they wished there were more funding available. One panelist
raised concern over the cost effectiveness of administering this new
grant program when funding for all arts programs is so limited.
Public comment was as follows:
Applicants raised the question of REDI bonus points and expressed concern
that REDI bonus points were not offered. One applicant mentioned that
OASIS made it hard for them to thoroughly explain their project information
as it had to be edited to fit the space provided. Audience members commented
that they appreciated the teleconference process. They found it much
less of a hardship to participate via phone in the panel meetings and
appreciated not having to make the trip to Tallahassee. Several applicants
and panelists on the call stressed the importance of advocacy for arts
funding and urged their colleagues to be in touch with their legislators.

Katharine Dickenson, chair of the Seed Funding panel, reviewed the report
as follows:
The Culture Builds Florida Seed Funding Panel Meeting was held via teleconference on May 23, 2008 to recommend grant awards to organizations for projects in the Culture Builds Florida Grant Program.
The panel reviewed twenty eligible applications and recommended the two highest scoring applications for full funding. Applications were accepted for projects that explored the connections between arts and cultural programming and the four key areas of the Division’s strategic plan.
Project applications were accepted for a variety of activities including an arts and business board development program, a residency program pairing seniors and at-risk youth, and the development of an arts district. The two organizations recommended for funding for this first cycle are:

Panel comment was as follows:
Panelists commented that though they wished there were more funding
available, they were glad that they could launch the two terrific projects
that funding allowed. A panelist commented that these two organizations
now had a greater burden to publicize the benefits of their programs
and make sure that they are clearly expressed to the legislators and
other authorizers in hopes of increased funding for the program next
year. Two panelists commented that they would like to see the application
format more closely mirror the scoring criteria, and suggested perhaps
editing the application narrative questions. Panelists also commented
that scoring criteria could be adjusted to make the scoring more welcoming
for those organizations applying with science and humanities projects.
Panelists also stressed the importance of applicants familiarizing themselves
with the vision areas outlined in the strategic plan. They suggested
that applicants reread this information and submit verification with
future applications that they are familiar with the plan and have read
the Executive Summaries provided on the Division’s website.
Public comment was as follows:
Applicants thanked the panel members for their time reviewing the applications.
Another applicant thanked both the panel and staff and mentioned that
their organization looks forward to applying to the program again. Members
of the panel and audience stressed the importance of advocacy for arts
funding and encouraged one another to be in touch with their legislators.
Jennifer Berges and Hans Wohlgefahrt, employees of the Sarasota Film Festival, requested that the Council exclude the scores of Media Arts Panelist, Victor Nunez on the grounds that Mr. Nunez did not recuse himself from scoring the Sarasota Film Festival Application (09-0417) by declaring a conflict of interest.
Russell Allen, Orlando Ballet, cautioned the Council on the potential effect of eliminating a panelist’s scores on future panels and that he thought the issue of conflict of interest was being too widely construed. Ilene Joyce Johnson with Esteem Music, Inc., Donna McBride of the Tampa Bay Performing Arts, and former FAC Chairwoman, Sibille Pritchard, also spoke about the panel process and the definition of conflict of interest.
G. Council Vote on All Grant Panel Funding Recommendations
Chairman Shaw asked for guidance from the staff as to the Council’s
options regarding Media Arts application #09-0417. Sarah Stage read
several of the comments regarding this particular application from the
actual panel meeting. Tim Deratany, following discussion with Margaret
Wise from Sarasota County, moved to drop Mr. Nunez’s score from
the application’s total score. Katharine Dickenson seconded the
motion.
Discussion on the motion was as follows: Jeff Tucker, chair of the Media Arts Panel, cautioned the Council on setting a precedent by changing the scores of a panel. Stephen Hogge noted that if a conflict of interest situation is not able to be addressed during the panel meeting, it should be able to be addressed at the Arts Council level. Also if Mr. Nunez’s score is removed, the final scores for the applicant should revert to the preliminary score. Lois Benson suggested that a new panel be convened to rescore the Media Arts Panel applications.
Don Blancett reviewed the Chapter 265, Florida Statutes, governing the Council’s authority to amend a panel’s recommendations. Jim Shaw read the administrative rule covering the Council’s authority.
Lois Benson presented a substitute motion that the Council vote on the all the panel recommendations, with the exception of the Media Arts Panel, and defer the conflict of interest issue to the department’s general counsel’s office for review. Katharine Dickenson seconded the motion.
Jon Ward presented another substitute motion that the Council vote on all the panel recommendations, except for the Media Arts Panel recommendations. Katharine Dickenson seconded the motion. The motion carried.
Lois Benson moved that Victor Nunez’s conflict of interest issue be referred to the department’s general counsel’s office for review and final legal opinion. Jon Ward seconded the motion. The motion carried.
Katharine Dickenson suggested that the Council’s position on whether or not a conflict existed, should accompany the Council’s request for legal opinion. Lois Benson noted that by requesting a legal opinion, already expresses a doubt as to whether or not a conflict existed which members of the Council are not equipped to determine due to lack of all evidence and legal expertise.
Sandy Shaughnessy will communicate the general counsel’s office findings as soon as possible, as well as what the next step will be in regard to final recommendations for the Media Arts Panel.
Gaylen Phillips reminded the Council that grant award documents will be delayed for all organizations recommended for funding in the Media Arts Panel. Many of the projects have a start date of July 1, 2008.
Stephen Hogge and Tim Deratany moved that if the department’s general counsel’s office determines that a conflict of interest did exist, the Florida Council on Arts and Culture recommends that Victor Nunez’s score be dropped only from application number #09-0417 and the preliminary scores be utilized to determine funding. Don Browning seconded the motion. The motion carried.

Don Blancett reviewed the legal opinion of the Office of the General Counsel regarding whether or not Victor Nunez had a conflict of interest regarding his scoring of the Sarasota Film Society’s Media Arts grant application (#09-0417). Lois Benson moved that the final scores from the Media Arts Panel Meeting be accepted as recommended, with Margaret Wise seconding. The motion passed.
Sandy Shaughnessy reported that a letter will be sent to the Sarasota Film Festival notifying them of the outcome and encouraging them to apply again in the future.
