The arts are no different from any other industry - the arts are a business and successful organizations are those that develop the right business skills. Non-profit cultural organizations or for-profit small businesses such as an art gallery, can benefit by the resources listed below.

The Division of Cultural Affairs is not a regulatory agency, nor does it provide licenses for most arts related, for-profit businesses. Art galleries, recording studios, etc. are not regulated. Talent agencies are licensed through the Department of Business and Professional Regulation.

Non-profit – An organization established for exclusively charitable purpose, in which any profits earned by the organization do not benefit any private shareholder or individual. The organization must be a corporation, community chest, fund, or foundation. The Internal Revenue Service provides a more detailed definition of requirements and exemptions of non-profit organizations.

For-profit – Businesses created for the sole purpose of generating profits to support its owner(s) or shareholders.
